By accessing or using PosterMock AI ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.
These Terms constitute a legally binding agreement between you ("User", "you") and PosterMock AI, operated by Oriol Mursola (Spain). Your continued use of the Service after any modification to these Terms constitutes your acceptance of the revised Terms.
PosterMock AI is an AI-powered tool that generates photorealistic room mockup images from artwork uploaded by users. The Service is intended for use by artists, designers, Etsy sellers, print-on-demand creators, and graphic designers.
The Service relies on third-party AI infrastructure — specifically the OpenAI API — to process uploaded images and generate room scenes. By using the Service, you acknowledge that your uploaded images are transmitted to OpenAI's systems for processing. OpenAI's own Usage Policies and Privacy Policy also apply to that processing.
You may use the Service as a guest (without an account) with a limited credit allocation. To access full features, save your mockup history, and maintain a subscription, you must create an account with a valid email address.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use at [email protected]. We are not liable for any loss or damage arising from your failure to protect your credentials.
You must be at least 18 years old to create an account and purchase a subscription.
The Pro plan is billed at $7.99 per month. Prices are displayed in USD and may be subject to local taxes where applicable (see Section 11). All payments are processed securely by Stripe, Inc. By purchasing a subscription, you also agree to Stripe's Terms of Service.
Subscriptions renew automatically at the end of each billing period. Your chosen payment method will be charged on the same date each month. You authorise us to charge your payment method on a recurring basis until you cancel.
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — you retain full Pro access and your remaining credits until that date. We do not prorate or refund partial months.
All subscription fees are non-refundable except where required by applicable consumer protection law. If you believe you have been charged in error, contact us within 14 days at [email protected].
EU and UK consumers have the right to withdraw from a digital service contract within 14 days of purchase, unless the service has been partially used. By generating your first AI mockup after subscribing, you expressly request immediate performance and acknowledge that your right of withdrawal may be lost proportionally to the credits consumed.
We may change subscription prices with at least 30 days' advance notice to registered users by email. Continued use of the Service after a price change constitutes your acceptance of the new price.
The Service operates on a credit system. Each AI generation (new room mockup or AI poster swap) costs 5 credits. Credits are allocated at the start of each billing cycle and do not roll over to the following month.
Credits have no monetary value, cannot be transferred, and are not refundable upon cancellation or account termination. Guest credits expire after 30 days of inactivity.
You retain full ownership of the artwork and images you upload to the Service ("User Content"). By uploading content, you grant PosterMock AI a limited, non-exclusive, royalty-free licence to process, resize, and transmit your images solely for the purpose of generating the requested mockup. This licence terminates when the generation is complete or when you delete your content.
We do not use your uploaded artwork to train AI models. We do not sell, share, or disclose your uploaded content to third parties, except as required to operate the Service (e.g. transmitting images to OpenAI's API for processing).
By uploading any image, you represent and warrant that:
You are solely responsible for ensuring you have the right to use and process any artwork you upload. PosterMock AI is not responsible for any copyright infringement arising from User Content.
We assign to you all rights, title, and interest that we may hold in the mockup images generated from your uploaded artwork ("Output Images"). You may use Output Images for any lawful commercial purpose, including in Etsy listings, print-on-demand platforms, social media, and marketing materials.
You should be aware that under current law in many jurisdictions — including the United States and the European Union — images generated autonomously by AI may not qualify for copyright protection due to a lack of sufficient human authorship. This means:
We make no warranties as to the copyrightability of Output Images in any specific jurisdiction. You should consult a qualified intellectual property lawyer if copyright protection is important to your business.
Output Images are generated by AI and may contain artefacts, imperfections, or unexpected elements. We do not guarantee any specific output quality, style accuracy, or fitness for a particular purpose. Credits consumed for a generation are non-refundable regardless of output quality.
The Service integrates the following third-party providers. Their respective terms and privacy policies apply to your use of their services as part of PosterMock AI:
We are not responsible for the availability, accuracy, or practices of these third-party services. Any disruption to third-party services may affect the availability of the Service.
We respect intellectual property rights and expect users to do the same. If you believe that content on the Service infringes your copyright, please send a written notice to us at [email protected] containing:
Upon receipt of a valid notice, we will investigate and take appropriate action, which may include removing the content and suspending the responsible account.
You agree not to use the Service to:
We reserve the right to suspend or terminate accounts that violate these rules without prior notice or refund.
Subscription fees are exclusive of taxes unless explicitly stated otherwise. Where required by law, applicable taxes (such as VAT, GST, or sales tax) will be added to your invoice and charged to your payment method.
You are solely responsible for any taxes applicable to your own sales of products or services produced using the Service (including Etsy listing sales). PosterMock AI does not collect, remit, or advise on taxes related to your own business activities.
We aim to keep the Service available at all times but do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue features or the Service as a whole with reasonable prior notice where possible. Planned maintenance will be communicated in advance where feasible.
We are not liable for any service interruptions caused by third-party infrastructure (OpenAI, Stripe, Supabase, hosting providers) or events beyond our reasonable control.
To the maximum extent permitted by applicable law, PosterMock AI and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or business opportunities — arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claims arising under or related to these Terms shall not exceed the total amount you paid to us in the three months prior to the event giving rise to the claim, or €50 — whichever is greater.
Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by our negligence, or liability for fraud or fraudulent misrepresentation.
You agree to indemnify, defend, and hold harmless PosterMock AI and its operators from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) User Content you upload; (c) your violation of these Terms; or (d) your infringement of any third-party rights.
We may suspend or terminate your account and access to the Service immediately and without notice if you violate these Terms, engage in fraudulent activity, or if continued access poses a risk to the Service or other users.
You may close your account at any time by contacting us at [email protected]. Upon account closure, your data will be handled in accordance with our Privacy Policy.
Sections 6, 7, 9, 13, and 14 survive termination of these Terms.
We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before they take effect. The "Last updated" date at the top of this page reflects the most recent revision. Your continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms.
These Terms are governed by the laws of Spain, without regard to its conflict of law provisions. Any disputes arising under or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.
If you are a consumer resident in the European Union, you may also have the right to submit a complaint to your local consumer protection authority or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. These Terms constitute the entire agreement between you and PosterMock AI regarding the Service and supersede all prior agreements.
